The Lacey Act requires that you declare each species in a shipment with its country of harvest and quantity. APHIS does not permit the use of common names. In cases where the species is unknown, the Lacey Act requires that you list all of the species that could be in the shipment.

 

 

Enter the scientific name for the article/component.   If the species of plant used to produce the product varies and the species used to produce the product is unknown, enter each species that may have been used to produce the product.

 

1.Enter a common name or a botanical name to search for a commodity, select the appropriate radio button and click the Search button.

RESULT:  The commodities matching the search criteria displays in the Commodity Search Results table.

 

2.From the Commodity search results, enter the number of rows to be added to the form for each commodity and click the Generate Rows button.  The corresponding Scientific name (botanical name) will be added to the List of Articles.  Any search will return a maximum of 1000 results.

NOTE: The number of rows added should correspond to the number of countries where the species was harvested.

 

3.Or if the product was manufactured prior to the Amendment and you cannot determine species, you can select the applicable Special Use Designation option.

Select one of the following Special Use options from the drop-down list and click Generate Rows button.

a.Special Composite
b.Special None
c.Special Pre-Amendment
d.Special Reclaimed
e.Special Recycled
f.Special SPF

The corresponding Scientific name will be added to the List of Articles.  Any search will return a maximum of 1000 results

NOTE: The number of rows added should correspond to the number of countries where the species was harvested.

 

4.You can enter details for each article row on this screen or on the Merchandise screen.  Click the Save button to save the List of Articles.

NOTE:  If no rows have been added and you click the Save button, the Article/Component of Article will not be added to the form.  If you are editing an existing Article/Component of Article and you delete all the rows, the Article/Component of Article will be removed from this form once you click the Save button.

RESULT:  You return to the Merchandise page and the complete List of Articles or Component of Articles row is displayed.

 

5.Additional rows can be added as needed by selecting another default HTSUS Number, Article/Component of Article, Line Number and Value.  Click the Enter Row Details button to complete the data for the List of Articles or Component of Articles.

 

6.On the Merchandise page, in the List of Articles/Components of Articles table, complete the following fields:
a.Country of Harvest - required field.
b.Quantity of Plant Material - required field.
c.Unit - required field.
d.Percent Recycled - optional field.
e.MID - optional field
f.BOL - optional field
g.Container Number - optional field

 

7.You can edit the row information by clicking the corresponding Edit button.

RESULT:  The Merchandise Details page appears and you can make changes as needed.  Click the Save button to return to the Merchandise page.

 

8.Once you have completed the merchandise information for the Plant and Plant Product Declaration Form, click the Next button.

RESULT:  The Summary/Submit page appears.

 

At any time during the form creation process, you may save your work for completion in the future.  To retrieve a Plant and Plant Product Declaration Form, follow the steps listed in the View Forms Help Topic.
